The law creates the Insulin Access and Affordability Program, run by the Oklahoma State Department of Health. The Department provides grants, when funded by the Legislature, to drug makers that make or develop fast-acting biosimilar insulin in the United States. Before any payment, the state must sign an agreement that commits the maker to a low net cost without rebates (unless required by law), U.S. manufacturing, and a set timeline. The maker must match state money dollar-for-dollar with non-state funds and repay funds if it fails to deliver or comply. Manufacturers file yearly progress reports; the Department sends a combined report to state leaders each year. The act includes an emergency clause and also lists July 1, 2026, as an effective date.
