Parents get notice and refusal rights

Beginning November 1, 2026, the medical examiner must tell you before starting an investigation of your child’s or infant’s death. You may refuse consent to any part of the investigation. You cannot refuse if a crime is suspected or if the death is one state law requires to be investigated.

Faster standard infant and child investigations

Beginning November 1, 2026, when an infant or child dies suddenly and the cause is unknown, the medical examiner starts an investigation within 48 hours. The investigation includes an autopsy when needed, microscopic and toxicology tests, checks of medical and immunization records, and an interview with a parent or caregiver. The examiner must complete the CDC SUIDI form and note any shots or emergency countermeasures from the prior 90 days. The examiner must report the case to the national SUID and SDY registry and send the form to the Oklahoma State Department of Health. The Health Department keeps each form and gives a copy to the Child Death Review Board.

Investigations for sudden heart rhythm deaths

Beginning November 1, 2026, if a sudden death may be from sudden arrhythmic death syndrome, the medical examiner investigates. The investigation includes an autopsy when needed, microscopic and toxicology tests, and checks of medical and immunization records. The examiner notes any shots or emergency countermeasures from the prior 90 days. If the person was under 20, the examiner must report the case to the SUID and SDY Case Registry and send it to the State Department of Health.

More deaths now must be investigated

Beginning November 1, 2026, Oklahoma adds more deaths that medical examiners must investigate. Maternal deaths during pregnancy or within one year after a pregnancy ends, when reported by a hospital or birthing center, are included. Deaths involving SIDS, SUID, SDY, and SADS are also clearly included.
