Clear memory care details before you sign

Beginning November 1, 2026, facilities that advertise memory care must use a state disclosure form. They must give the form to the Health Department, your representative, and the State Long-Term Care Ombudsman. The form must cover mission, admission and discharge rules, care plans, staff ratios and training, building features, activities, family support, fees, and certifications. Facilities must file the form before signing any care agreement.

Easy online access to memory care forms

Beginning November 1, 2026, the Health Department keeps a public website that lists facilities with filed forms, links to each form, and shows staffing, training, activities, and certifications. If you tell a referral agency you have Alzheimer’s or another dementia and are considering memory care, it must give you access to the forms, if the Department has them. Facilities with a memory-care unit must post the form on their website and display a poster in the unit with how to complain to the Attorney General’s Consumer Protection Unit if the form was not provided.

State oversight and enforcement for memory care

Beginning November 1, 2026, the Health Department develops a standard disclosure form and requires updates when details change. The State Commissioner of Health writes rules to carry out the law. The Department checks each submission for completeness and reviews the latest form during regular inspections to verify services match what is promised. If a facility or its staff violate the law, the Department can use licensing enforcement.
