Starting November 1, 2026, the Department of Human Services can offer programs to people with developmental disabilities who are not currently served, but only if funds and staff are available. People who were getting state services for intellectual disabilities on September 1, 1991 keep their eligibility. This protects that group from losing services under the new definitions.
Starting November 1, 2026, the state updates who counts as having an intellectual disability. You must have an IQ under 70, the condition began before age 18, and you have limits in two or more of ten named skill areas. Meeting the Social Security Administration’s listing for intellectual disorders also qualifies. The law also defines “developmental disability” as a severe, long-lasting condition that starts before age 22, is likely to continue, and causes big limits in three or more major life areas, with a need for coordinated long‑term services. People whose only disability is mental illness (as defined in state law) are excluded. These definitions guide who can get state disability supports and services.
Starting November 1, 2026, a “resident” is someone admitted to and living in a state institution named in law. You still count as a resident while on vacation or extended vacation from that institution. This definition guides who gets services tied to resident status.
