Bill Overview

Analyzed Economic Effects

4 provisions identified: 1 benefits, 1 costs, 2 mixed.

Exemptions for schools and ABA pilot

Beginning November 1, 2026, people with a qualifying degree who are actively in the state ABA treatment pilot do not need a state ABA license while in the pilot. School district employees who provide services only to their district under the Individuals with Disabilities Education Act (IDEA) are also exempt.

ABA renewals and $100 fee cap

Beginning November 1, 2026, renew your license or certificate on or before April 30 of odd-numbered years. The Board sets the fee. Each issuance or renewal fee cannot be more than $100.

Psychology Board now licenses and enforces ABA

Beginning November 1, 2026, the State Board of Examiners of Psychologists, not DHS, controls ABA licenses and certificates. The Board sets rules and investigates all complaints about ABA practice, supervision, and unlicensed practice, and sends proven cases to the national certification board. Only licensed analysts may practice or supervise; supervisees must work under a licensed analyst. Breaking these rules can bring a fine up to $500 and suspension or revocation of a license or certificate.

Who can get an ABA license

Beginning November 1, 2026, applicants must be at least 21, show good moral character, pass the national exam, hold BACB certification, and have the required degree. Applicants must disclose past license problems; the Board may still license you if you show corrective reasons. All applicants must complete a national criminal history check under Title 74, Section 150.9. The Board cannot share the background check results.
