Limits on repeat cold case reviews

Starting 2026-11-01, only one review can happen at a time for the same victim. If a review finds no more investigation is warranted, there is no new review for at least five years unless new, materially significant evidence appears. If follow-up investigation does not identify a suspect, there is no new review or further investigation for at least five years.

Families can request cold case review

Beginning 2026-11-01, an immediate family member or a similar person the agency recognizes can ask for a cold case review. A cold case is a violent crime with no likely suspect and no remaining leads. The agency must confirm it got the request within 30 days and decide within six months if more investigation is warranted. It can extend the deadline by up to six months at a time, with written notice and reasons, if caseload makes this impracticable. Reviewers cannot be the original investigators. The review must recheck steps, consider reinterviewing witnesses, reevaluate evidence and forensic tests, and update the file to modern standards. Agencies must coordinate if more than one is involved, and they must give you updates and meet to explain results and next steps. These rules do not limit the agency’s ability to keep investigating.
