Parents can share identities by consent

If both the birth parent and the adoptive or prospective parent agree in writing, helpers in the case can share their identifying information. This includes court or Human Services staff, agency workers, attorneys, doctors, ministers, and others helping with the adoption. Each parent must sign written notice of the agreement and give it to the court, Human Services, the agency, or an involved attorney.

Human Services shares contacts for care coordination

The Department of Human Services can give an adoptive parent's contact info and other needed care details to the company that runs the Children's Specialty Plan. This only applies if the adopted child is enrolled in that plan. Sharing is limited to what is needed to keep the child's care going.

Penalty for leaking adoption records

Anyone who has custody of, or access to, adoption records commits a misdemeanor if they illegally disclose information. The charge applies only after a court conviction. Confidentiality exceptions in law still apply.

Closed hearings and sealed adoption records

Adoption hearings are closed to the public. Only parties and their lawyers may attend unless the judge orders otherwise. All adoption papers and records are kept forever in a separate court file and are confidential. You can see or copy them only as state law allows, or if a judge finds good cause. To get a court order, you must apply, give notice to the record holder, and the judge must write findings, including why other legal methods cannot get the information. The judge can also limit how you use any information released.

Law takes effect immediately

The law takes effect right away. It is in full force from and after its passage and approval.
