Businesses can choose foreign law in contracts

Corporations, partnerships, LLCs, and similar entities can agree to be governed by foreign law in their contracts. The bans on foreign-law clauses do not apply when a business entity chooses foreign law for itself. This applies when the entity clearly agrees to be governed by that foreign law.

Protects religious freedom and church self-rule

The law preserves everyone’s right to practice their religion under the Oklahoma and U.S. Constitutions. Courts do not step into church matters like choosing leaders, discipline, or doctrine, unless doing so would break those constitutions.

Defines rights and what foreign law means

The law defines which rights it protects. They include due process, equal protection, religion, speech, and press. It also covers keeping and bearing arms, privacy, and marriage as defined by Oklahoma law, unless federal law or the U.S. Supreme Court says otherwise. It defines foreign law as laws outside any U.S. state or territory, including international bodies. Tribal law inside Oklahoma is not treated as foreign law.

Limits on foreign law in Oklahoma cases

Oklahoma courts and agencies cannot enforce rulings that rely on foreign law when it conflicts with the listed rights. Contract terms that choose such foreign law are void in Oklahoma cases. Forum or jurisdiction clauses that force a case where such foreign law would apply are also void. This changes how cases and contracts are decided, not taxes or payments.
