Clearer rules to serve insurers

Beginning November 1, 2026, foreign or alien insurers must name an irrevocable agent to get legal papers (not subpoenas). The agent can be the Insurance Commissioner, an Oklahoma resident, or a person allowed to do business in Oklahoma. The appointment is irrevocable, binds any successor, and stays in place while the insurer’s Oklahoma contracts or duties remain. Service against foreign or alien insurers must be made only on that agent. Service against domestic insurers follows general business rules, or on the attorney-in-fact for reciprocal insurers and Lloyd’s associations. When applying for a certificate of authority, insurers must file who should receive forwarded papers and may update it. If they use a private registered agent, they must e-file the agent’s name and address, keep it current, and report changes within five business days; the Commissioner makes this agent list public. Serving the Commissioner and the Commissioner’s forwarding to the insurer’s designee counts as service on the insurer.

Time limit paused if agent wrong

Beginning November 1, 2026, if someone reasonably relies on the Commissioner’s agent list and serves a listed agent that is wrong, service may be made on the Commissioner instead. The Commissioner forwards a copy to the insurer. If the person used due diligence to serve the Commissioner, the statute of limitations pauses from when the wrong agent got the papers until the Commissioner gets them.

Serve insurers through Commissioner, $20 fee

Beginning November 1, 2026, when the Insurance Commissioner is the insurer’s agent, plaintiffs must serve three copies at the Insurance Department. Service may be by mail with return receipt, and proof of mailing is enough. Plaintiffs must pay $20 at the time of service; the fee is taxable as court costs. The Commissioner promptly mails a copy to the insurer’s last designated recipient.
