Crackdown on fake police and gear

Beginning November 1, 2026, it is a Class D1 felony to pretend to be a peace officer. Courts can impose prison time and a fine up to $10,000. You also cannot put police-style insignia on a car to make others stop. That crime can be a misdemeanor with up to a $1,000 fine and up to one year in jail, or a Class D1 felony with up to a $10,000 fine and prison. Fire, police, ambulance, and other authorized emergency vehicles are exempt. Peace officers may seize gear, cars, boats, planes, and other items used to impersonate law enforcement.

New Class D1 felony rules and penalties

Beginning January 1, 2026, many listed crimes are Class D1 felonies. A Class D1 sentence can be up to 5 years, and at least 20% must be served. Repeat offenders face more time: 1–7 years with 20% for 1–2 Class C/D priors; 2–10 years with 30% for 3+ C/D or any Y/A/B prior. Fines for these crimes follow the fines already set in state law. Section 51.1 generally does not apply to Class D1, unless subsection E allows it. Some listed crimes are carved out and keep their own penalties.
