Beginning November 1, 2026, farms, ranches, and horticulture employers that paid under $250,000 in wages last year are exempt from treating those workers as employees under state workers' compensation. This lowers coverage obligations for small agricultural employers. Some workers may lose workers' compensation coverage if they are not treated as employees. The separate independent-contractor rule still applies only if the worker meets at least four listed conditions, like controlling how work is done, being paid per job, being able to work for others, and having a chance of profit or loss.
Beginning November 1, 2026, an Oklahoma National Guard member is treated as an employee while on state-ordered duty. This makes the member eligible for workers' compensation for injuries or illness from that duty.
The law takes effect November 1, 2026. All changes apply starting that date unless the law sets a different date.
