On or after January 1, 2026, the state treats 14 listed crimes as Class B6 felonies. These include assaults by people in custody on Department of Corrections, private prison, DHS, or juvenile staff while they are doing their jobs, without justifiable or excusable cause. It also includes harming police dogs or service animals, assaults on medical providers and court officers, aggravated assaults on school employees, throwing bodily fluids on public employees, medical battery, and child endangerment. People convicted face higher felony penalties. The act’s general effective date is November 1, 2026.
On or after January 1, 2026, the state treats 40 listed crimes as Class B5 felonies. Examples include repeat domestic abuse, strangulation, aggravated assault, assaults on officers, animal fighting and cruelty, stalking, and some DUI injury and manslaughter offenses. It also covers sex‑offender failures to register and some residency limits, like living within 2,000 feet of a school. People convicted face tougher felony sentences and penalties. The act’s general effective date is November 1, 2026.
On or after January 1, 2026, if a person in Office of Juvenile Affairs custody, without justifiable or excusable cause, injures an OJA employee, a residential facility employee, or a county detention contractor who is doing their job, it is a Class B5 felony. The court can fine $500 to $5,000 per conviction, even without jail time. People convicted also face felony sentencing. The act’s general effective date is November 1, 2026.
