Beginning 2026-11-01, on a designated open pasture road, the property owner and the livestock owner are not liable for damage or injuries from a vehicle hitting livestock. Motorists cannot collect damages from those owners for such crashes on these roads.
Beginning 2026-11-01, owners with a designated open pasture road must send the county a yearly notice that they still meet the rules and want to keep the designation. If the owner no longer wants it or no longer meets the rules, the road loses the designation. After the county gets that notice, the owner has 30 days to fence animals off the roadway.
Beginning 2026-11-01, a county road is designated an open pasture road only if, by 2025-11-01, it had cattle guards at access points, the same owner or lessee on both sides, and no fencing. The owner must ask the county board in writing, include a map showing the road and its ends, and show proof of ownership. The county puts up cattle crossing signs at the road’s ends, and the requesting owner pays for the signs. Roads that first meet these rules after 2025-11-01 cannot be designated. On these roads, cattle may be unrestrained.
