Cities remove discriminatory covenants from plats

Beginning November 1, 2026, any illegal discriminatory restriction in a recorded plat is unlawful and void. Your city can amend the plat to strike that language. The city must give every owner 30 days’ written notice with the planning commission meeting time, date, and place, and the city council must approve. Owner consent is not required. After the city records the change and files an affidavit naming the plat, where it is recorded, and the words to remove, the county clerk must redact the online plat.
