Beginning July 1, 2026, any person may possess, store, buy, donate, give out, or use FDA‑approved naloxone. A person may give naloxone to someone they reasonably and in good faith believe is overdosing. Giving out naloxone must still follow federal law. People acting under this law are not subject to criminal prosecution for these actions. Those who act in good faith are protected from civil lawsuits, except for gross negligence or willful or wanton wrongs. “Person” includes individuals, businesses, governments, tribes, and colleges.
