Personalized experimental treatments for seriously ill patients

Beginning November 1, 2026, eligible patients can seek individualized investigational treatments. You must have a life‑threatening or severely debilitating illness and have tried approved options. Your doctor must recommend it based on genomic analysis and document that you qualify. You must sign written informed consent that explains risks, possible outcomes, and costs. The treatment must be made and given inside an eligible facility that operates under a Federalwide Assurance, and no manufacturer is required to offer it.

Provider protections and limits on lawsuits

Starting November 1, 2026, licensing boards and Medicare certification bodies cannot act against a provider just for recommending an individualized investigational treatment. State officials cannot block an eligible patient’s access. Giving advice that follows medical standards is allowed. You cannot bring a private lawsuit for harm from these treatments if those involved acted in good faith and used reasonable care.

What patients may pay for these treatments

Starting November 1, 2026, an eligible facility or manufacturer may give an individualized treatment for free or charge you for manufacturing or related costs. The law sets no price caps. Health plans or government agencies may choose to pay, but they do not have to. Hospitals do not have to add new services unless approved. If a patient dies while on the treatment, heirs do not owe debt tied to that treatment.
