Nongovernment healthcare entities qualify as 340B entities only when they meet both funding requirements. They must receive in-kind funding from Tennessee or a Tennessee local government under Public Health Service Act sections 317 or 318. They must also receive at least one state or federal grant subject to audits, reporting, and oversight under both state and federal law. The Tennessee Comptroller and the state agencies or local governments providing in-kind funding can check eligibility and enforce these rules.
