Survey marker protections carry new penalties

Beginning July 1, 2026, Tennessee protects three types of survey markers through a new Class A misdemeanor offense. People cannot intentionally move them without replacing them, alter them, destroy them, or remove them. This applies when someone knows or reasonably should know the object is a protected marker. Protected property markers identify corners or lines, are established by licensed surveyors, and have locations and descriptions in county deed records. These can include metal stakes, stones, trees, or other recorded markers. Protected historic markers are government-established markers identifying state, county, or city boundaries. Protected geodetic markers are survey reference points established by licensed surveyors and government agencies, marked as control points or with warnings. Tennessee Department of Transportation employees and contractors are exempt while performing official duties for the department.
