Faster environmental permit and penalty appeals

The law standardizes how you appeal environmental permits, orders, citations, or fines. One administrative judge hears the case as a contested hearing. The judge must hold a scheduling conference within 30 days and set a plan to finish the hearing within 180 days, unless more time is allowed for good cause or by agreement. The judge must issue an initial order within 90 days after the record closes. You have 15 days after entry to appeal to the board, which reviews the case anew on the record and issues the final order. Final orders take effect when entered. For certain facility-site petitions, the hearing must be held in the local environmental field office region.
