More care and protections after prison childbirth
Beginning May 6, 2026, Utah correctional facilities must provide access to postpartum care for the full 12 weeks after birth. Pregnant inmates also get social-worker access, and access after birth grows from six to 12 weeks. Social workers help arrange childcare, plan family reunification, and make substance-use treatment plans when needed. During postpartum recovery, staff may use only the least restrictive restraints, based on a documented individual finding of immediate, serious danger or a substantial escape risk that other means cannot reasonably reduce. Shackles, leg restraints, and waist restraints are never allowed during those 12 weeks.
New housing limits for transgender inmates
Beginning May 6, 2026, Utah prisons and county jails limit housing assignments for transgender inmates. Placement with inmates of a different biological sex at birth requires an individual security review. The review must find low risk of physical or psychological harm, facility disruption, and security problems. Placement is barred when evidence shows the inmate claims a different gender identity or expression solely to change housing. Facilities must review placements regularly and after security incidents, and move inmates when these requirements are no longer met.
