Beginning May 6, 2026, a micro-education entity cannot enroll more than 100 students, even if its building holds more. Building capacity still follows state construction codes and applicable zoning and land-use rules.
Beginning May 6, 2026, local governments can regulate home-based microschools and micro-education entities without conflicting with the law. Rules can cover traffic, street types or sizes tied to projected enrollment or impacts, noise, and graduated lot-size requirements. They can also cover operating hours, specified zone standards, and other relevant matters. Location restrictions must be necessary to avoid health or safety risks, protecting safety while limiting where schools operate. Local governments do not have to adopt an ordinance.
Beginning May 6, 2026, micro-education entities can use Group E buildings or buildings classified as A-1, A-3, B, or M. Those alternative building types need code-compliant fire alarms and carbon monoxide detection. Each classroom needs a direct outside exit at the exit or discharge level, unless the structure has code-compliant sprinklers. Fire areas over 12,000 square feet need automatic sprinklers. Buildings in any zone can be converted for micro-education use, subject to state construction codes and applicable local ordinances. Required permits, plan reviews, and inspections for changes in occupancy classification still apply.
