Beginning May 6, 2026, Utah’s adjutant general can accept gifts for more National Guard purposes. Added purposes include the State Partnership Program, humanitarian programs, and disaster or emergency response. This expands existing authority to accept gifts for a state military museum or a memorial honoring National Guard activities. The law sets no gift amount and requires no one to donate or accept gifts.
Beginning May 6, 2026, the law extends military land-use protections to Utah’s Naval Industrial Reserve Ordnance Plant. Municipalities within 5,000 feet must develop and maintain plans with Utah’s Department of Veterans and Military Affairs. These plans address whether permitted and conditional land uses fit with military operations. The law retains the July 1, 2025 planning deadline; plans in effect January 1, 2023 need not be replaced. Before approving land-use applications within 5,000 feet, municipalities must notify the department in writing. Its executive director must issue a written compatibility finding within 90 days. Municipalities must consider the plan for parcels that may harm military operations, unless applicants have vested rights. These are legally established rights to proceed with a land use. If notice arrives before planning is complete, the department must consult municipal and military representatives to determine compatibility.
