Parents gain notice before special-education class moves

Local education agencies must give parents written notice at least 30 days before a boundary change moves their child's special class. This covers designated classes only for students with disabilities, not special enrollment programs. Notices must explain the reason, impact, new site, timeline, staff contacts, transportation information, transfer services, and how to schedule an individualized education program meeting. Notice can arrive by regular mail, certified mail, email, or hand delivery. Before implementation, agencies must allow written or verbal comments, document and consider each comment, and respond before finalizing the decision. These notice and comment rules do not apply to moves required to comply with the law's special enrollment program requirement.
