Beginning May 6, 2026, Utah blocks cities and other local governments from imposing specified firearm-related civil liability. The ban covers liability for manufacturers, sellers, and trade groups over criminal misuse, alteration, or modification of covered products. State law overrides existing local rules of this kind, limiting local paths for seeking relief.
Beginning May 6, 2026, Utah expands civil-liability limits for firearm manufacturers, sellers, trade groups, and specified associated people. Covered products include guns, ammunition, antique guns, accessories, and products intended for use with guns or ammunition. Manufacturers no longer need a federal license to qualify. Covered claims require a listed exception and detailed facts showing the defendant’s state of mind and direct legal responsibility for harm. Exceptions include specified negligence, law-breaking, contract, warranty, and product-defect claims; negligent-entrustment claims have limits when sellers did not directly entrust the product. Courts must read exceptions narrowly and dismiss claims that fail these requirements. Foreign nations cannot use the exceptions.
Beginning May 6, 2026, defendants who win dismissal under Utah’s firearm-liability rules get reasonable attorney fees and court costs. The party bringing the claim faces potential responsibility for those expenses. Defendants can also appeal a denial of that dismissal request before the case ends.
