Bill Overview

Analyzed Economic Effects

8 provisions identified: 4 benefits, 2 costs, 2 mixed.

More child support reaches assistance families

Beginning July 1, 2028, families whose support rights were assigned for public assistance receive more of their collected child support. As federal rules allow, the monthly amount is up to $100 for one child or $200 for two or more. If the monthly payment is below that limit, the family receives the full payment.

Unpaid child support triggers license suspension

Utah’s Office of Recovery Services must order driver’s license suspension for qualifying child-support debt arising on or after May 6, 2026. The person must owe at least $35,000 and have gone 60 days without a full monthly child-support payment. Suspension follows a final finding after the hearing and appeal process, or failure to request a hearing on time. The person has 30 days to request an informal hearing after notice. Exceptions include full payment, a qualifying payment agreement, a court stay, or no current delinquency.

Spousal support collection continues after child support

Utah’s Office of Recovery Services must collect spousal support in qualifying spousal-support-only cases. Recipients can request continued collection after child-support collection ends and the related case closes, if the office previously collected both together. Collection continues until the support is no longer enforceable or the recipient asks the office to stop. The office must use the same collection and enforcement methods available for child support.

Late child support carries interest

Beginning July 1, 2027, delinquent child-support payments carry 6% annual interest. Interest applies only to unpaid principal, from the date the payment becomes delinquent until it is paid.

Same-sex parents face equal support enforcement

Utah’s Office of Recovery Services can establish and enforce child support against alleged parents currently or formerly in same-sex marriages. The same terms apply as for other mothers and fathers. This supports collection for children while subjecting those alleged parents to support obligations.

Online court users get fee limits

Beginning May 6, 2026, Utah cannot charge for using its Online Court Assistance Program or filing later papers through it. The separate $20 fee for an initial pleading prepared through the program remains. The program must explain how people representing themselves can find relevant records from other cases, including through the Xchange database. This guidance does not grant new access rights or change who may see court records.

Support appeals use courts with jurisdiction

Beginning May 6, 2026, individuals can appeal Office of Recovery Services decisions to a court with jurisdiction. The law replaces the prior wording that specified district court. It does not itself change the agency’s decision or provide a monetary award.

Spousal support shifts to electronic payments

In spousal-support-only cases, recipients must receive payments electronically through a bank account or an account accessible by card. Rules may allow exceptions for undue hardship to the office or a person, or payments unlikely to recur. People paying support can make written automatic-withdrawal agreements with the office instead of having support withheld from income. Agreements must state the withdrawal date and amount. The office may end them for legal reasons or insufficient funds; insufficient-funds termination bars another agreement for at least 12 months.
