Utah employers get retirement plan comparisons

The law creates a secure, public retirement plan comparison website run by Utah’s treasurer. Private employers operating in Utah with at least one W-2 employee can use it, without having to offer a plan. It lists automatic-enrollment retirement accounts and 401(k) plans, with fees, investment performance, enrollment steps, and educational tools. Outreach focuses on small businesses with 50 or fewer employees. The office must establish the platform and accept provider applications by November 2, 2026; operations must begin by January 1, 2027. Providers must apply, meet legal standards, accept monitoring, and promptly report legal or regulatory actions affecting compliance. The office can suspend or remove providers for misleading information, excessive fees, asset mismanagement, or other listed failures. For the first 24 calendar months, neutral rules can limit listed providers. The office can limit plans shown to each employer, but must present providers fairly and publish the full plan list. The state does not sponsor plans, take on duties to manage participants’ money, give personal investment advice, or guarantee returns. The treasurer must adopt operating rules; outside contractors cannot be plan providers. The law takes effect May 6, 2026, and provides no new funding for the exchange.

Retirement provider reports get disclosure protections

Participating retirement plan providers must send the Utah treasurer annual reports for each fiscal year. Reports include employer and employee counts, plan assets, average account balances, employee opt-out rates, and major plan changes. The law classifies these reports as protected government records, limiting public access. This does not change who qualifies for retirement benefits.
