Fewer job restrictions for healthcare workers
Beginning May 6, 2026, new non-competes restricting covered Utah healthcare workers' practice by time or location after work ends are void. Coverage requires work that involves practicing under a healthcare license listed in Utah law. Exceptions remain for reasonable severance agreements freely and mutually made in good faith at or after termination, subject to common-law standards, and business-sale agreements when the worker receives value from the sale. New nonsolicitation agreements signed on or after that date also cannot stop these workers from telling patients their current or future workplace. When an employer seeks enforcement through arbitration or court and the healthcare non-compete is found unenforceable, the employer must pay the employee's arbitration costs, reasonable lawyer fees, court costs, and actual damages.
