Bill Overview

Analyzed Economic Effects

3 provisions identified: 1 benefits, 2 costs, 0 mixed.

More grant support for local oil collection

Beginning May 6, 2026, grants support new used oil collection centers and curbside programs when funding is available. Curbside grants can pay for permitted transporters, truck changes, containers, and other program costs. The division can seek gifts, grants, and donations, alongside appropriations, to fund the program account. Money goes first to division and board costs, then collection incentives, public education, collection grants, and local health department enforcement. The board must work with government bodies to promote collection facilities in rural areas and places with limited access.

Higher recycling fees for Utah oil buyers

Vendors collect a recycling fee on their first sale of lubricating oil in Utah. Buyers may pay this cost in the price. The fee remains 4 cents per quart, or 16 cents per gallon, through June 30, 2026. From July 1, 2026, through June 30, 2027, it doubles to 8 cents per quart, or 32 cents per gallon. Beginning July 1, 2027, the state division sets the fee under the Budgetary Procedures Act. Changes take effect at a calendar quarter's start, at least 90 days after notice to the State Tax Commission. Exempt sales include out-of-state shipments, containers of 55 gallons or more, and containers of 5 gallons or less used solely in underground mining. The fee is separate from other state and local charges; sales-tax exemptions do not waive it. Vendors pay the commission monthly or quarterly, matching their sales-tax filing schedule, using a commission-prescribed form. They can keep no more than 2% for collection costs. The commission can adopt rules to carry out and enforce these requirements.

Limits on payments for used oil collection

Beginning May 6, 2026, incentive payments cover only qualifying used oil from people who change their own oil. Collection must go through a registered center or a director-approved curbside program. A permitted transporter must take the oil to a permitted processor, rerefiner, burner, or disposal method allowed by board rules. The payment is 16 cents per gallon, subject to the program's spending priorities. The board can lower it to meet those priorities and reimburse qualified operations. It can raise the payment to promote collection only when money remains after those priorities are met.
