New annual fees for aggregate businesses

Utah's air quality division may charge covered aggregate businesses an annual compliance fee beginning July 1, 2027. Through June 30, 2028, maximum fees depend on yearly air pollutant emissions: $750 for 20 tons or fewer; $1,500 for 20–79 tons; $3,500 for 79–99 tons; and $4,500 for 99 tons or more. Beginning July 1, 2028, fees follow Utah's budget procedures, and the Air Quality Board can adopt rules to implement them. Covered operations commercially extract, crush, screen, grind, store, or transport sand, gravel, stone, or other aggregate and require an air permit. Excluded materials include metal-bearing minerals, mineral salts, gemstones, coal and other energy-rich materials, and sand used in hydraulic fracturing.

Dusty sites must post public signs

Beginning May 6, 2026, covered Utah dust-producing commercial sites must post signs at an entryway clearly visible to the public. Sites must be larger than a quarter acre and required by Utah's air quality division to complete a dust control plan. Signs must show the site's name, permit number, business number, and contact details for its manager or owner and the division. Covered sites include aggregate operations, excavation sites, and topsoil or bulk material handling sites. Agricultural and horticultural operations, plus road sanding or salting for snow and ice control, are excluded.
