Bill Overview

Analyzed Economic Effects

4 provisions identified: 1 benefits, 2 costs, 1 mixed.

Subcontractors share fewer employee identity details

Starting May 6, 2026, public-project subcontractors must provide employee details to the licensing division on request. These include names, the last four Social Security number digits, and professional license numbers when applicable. Beginning January 1, 2027, the required details no longer include Social Security number digits. Employee names and applicable professional license numbers remain required on request.

New insurance promises for employers without workers

Insurers must get a signed statement in capital letters from applicants for zero estimated exposure workers’ compensation policies. Applicants must confirm they have no employees, have zero estimated exposure, and gave current, accurate, complete information. If they hire employees during coverage, they must notify the insurer in writing within 60 days after employment begins. The notice must include estimated payroll and employee job classification codes. The statement warns that intentional omissions or false statements made to defraud can be criminal fraud.

Public-project subcontractors face new reporting duties

Beginning May 6, 2026, public-project subcontractors must provide current employee lists and estimated labor hours before starting construction work. They must disclose planned second-tier subcontractors’ names and license numbers, plus any zero estimated exposure policy and a copy. Employees on site must have photo identification and show it to the licensing division on request. General contractors and property owners must keep subcontractor information for three years and provide it on request. The division can share information and audit recommendations with the State Tax Commission; licensees who fail to comply face licensing consequences.

New unemployment payment rules for employers

Utah replaces the fixed 1% monthly interest rate on overdue unemployment contributions with a rate set by agency rule. Interest runs from the due date until the agency receives both the contribution and interest. Rules also set penalties for late reports, missing information, employee misclassification, late reimbursable-employer reports, and contributions unpaid after written demand. Employers avoid the unpaid-contribution penalty by arranging payment within 10 days after demand is mailed or delivered and following that agreement. Reasonable cause without willful neglect protects against failure-to-file penalties, but reporting violations can trigger a required bond; replacement rates and amounts are unspecified.
