Beginning May 6, 2026, Utah facilities must let eligible patients travel between health facilities without an ambulance. These rides provide no medical services or trained medical staff and include family rides or public transit. Patients can ask the facility or provider to check their eligibility. Patients cannot be under temporary or involuntary commitment. Their originating provider must find no condition covered by Utah Code 53-2d-405 and no medical or mental need for an ambulance. The transfer must also follow federal emergency care law. Facilities must give eligible patients written notice that an ambulance is not medically necessary, insurance may deny coverage, and patients may owe the charges. The notice must list current state-established transportation and mileage rates. The law does not say who pays for nonmedical rides and preserves patients' right to refuse care, including transportation.
Beginning May 6, 2026, patients using eligible nonmedical transfers get bed and billing protections when they arrive on time. The limit is four hours when the originating facility is in a fourth-, fifth-, or sixth-class Utah county. It is two hours for all other originating facilities. The receiving facility cannot charge patients or their health plans for admission or readmission unless staff have reason to believe the patient's medical condition changed since discharge. It also cannot give another person the bed offered to the patient at discharge.
Beginning May 6, 2026, originating facilities and providers are protected from civil lawsuits for acts or omissions when allowing nonmedical transfers. This protection applies only when the patient's medical or mental condition at discharge did not require an ambulance. It limits patients' ability to bring civil claims over those qualifying acts or omissions.
