Growing Municipalities Gain Transportation Project Priority
Beginning May 6, 2026, covered Utah municipalities gain extra transportation priority when a compliant report shows enough housing growth. Residential units must grow by at least 2.5% over the prior 12 months. The Transportation Commission must give priority consideration to a significant regional project it finds benefits the municipality. That project can be inside or outside municipal borders, but priority does not guarantee funding.
Local Governments Keep Housing Compliance Status
Beginning May 6, 2026, covered Utah municipalities and counties can carry their 2025 housing reporting compliance into reporting year 2026. Those that qualified for transportation priority in 2025 also keep that status for 2026. For municipalities, Utah's transportation department must have received their priority notice in 2025 to recognize that eligibility. Priority status does not guarantee project funding.
Municipalities Gain Credit for Housing Projects
Beginning May 6, 2026, Utah municipalities without a fixed-guideway public transit station gain another way to meet housing requirements. Approval or completion of the project identified in Utah Code 10-21-201(3)(a)(iii)(AA) counts as three moderate-income housing strategies. The municipality must implement, or be implementing, the project through an ordinance or development agreement. It is considered compliant for that reporting year and the next two reporting years.
Municipal Transportation Priority Gets Scoring Cap
Beginning May 6, 2026, the Utah Transportation Commission must limit the scoring boost from this transportation priority rule. Total priority consideration under Utah Code 72-1-304(3) cannot raise a project's score by more than 7%. This caps the ranking advantage, but does not decide which projects receive money.
