In Utah’s second-class counties, local leaders can exempt an unincorporated island or part of one from automatic annexation. They must adopt a resolution by May 1, 2027, describing or mapping each exempt area. In counties with fewer than 600,000 residents, the county legislative body acts. In counties with 600,000 or more residents, a municipal legislative body acts. Property owners do not receive an individual right to opt out.
Beginning May 6, 2026, final local boundary documents for proposed annexations can include separate areas that do not touch. They can provide a map or complete, accurate boundary details. The information must let the county surveyor locate boundaries in a dispute and the county recorder identify tax parcels. These document rules do not themselves annex property or change household tax bills.
Beginning July 1, 2027, qualifying unincorporated islands in Utah’s second-class counties automatically become part of the surrounding city or town. Each area must be 55 acres or smaller and completely surrounded by one municipality. It must receive municipal sewer or drinking water, lack public infrastructure, or have infrastructure meeting municipal codes and standards. Annexation remains subject to the law’s effective-date rules and local exemptions. By May 1, 2027, counties must mail each property owner notice and post it on the Utah Public Notice Website. Counties must consult the receiving municipality; notices must describe and map the area, state the annexation date, and explain services and contacts.
