Narrower licensing rules for care program associates

Beginning May 6, 2026, the law limits who counts as associated with a licensed human-services provider. Covered people hold or previously held roles involving management, control, or significant influence over operations or compliance. These include specified owners, officers, managers, and supervisors. Board service for specified local mental health or substance abuse authorities and related organizations is excluded unless it includes direct access to children or vulnerable adults. Guests and visitors are excluded when their access to children or vulnerable adults is directly supervised at all times.

New treatment categories for care providers

Beginning May 6, 2026, day treatment means specialized care lasting less than 24 hours a day. It covers four or more people served individually or in groups during any 30-day period. Clients must be unrelated to the owner or provider and have emotional, psychological, developmental, physical, or behavioral impairments or chemical dependencies. Applied Behavior Analysis for these clients counts as day treatment by default. Providers can overcome that classification by showing the Office of Licensing that their services meet the outpatient-treatment definition.
