Beginning July 1, 2025, qualifying lease or permit holders must be offered Utah trust land when the director approves its sale. They must have held a valid surface lease or permit for at least 25 consecutive years. The land must total no more than 640 acres and have no authorized public access when sold. Buyers must agree to pay fair market value, which cannot exceed the highest credible offer received. The law does not set a fixed price or guarantee savings.
Beginning July 1, 2025, Utah changes civil and criminal penalties for unauthorized use of school and institutional trust lands. Covered conduct includes occupying land, causing waste, dumping refuse, and interfering with staff or authorized activities. The person must act intentionally, knowingly, or recklessly without the director’s written permission; some previously listed offenses are removed. Civil damages can reach three times applicable measures of value or loss. Criminal penalties depend on property damage or financial loss: $5,000 or more is a second-degree felony; $1,500 to under $5,000, a third-degree felony; $500 to under $1,500, a class A misdemeanor; and loss under $500, a class B misdemeanor. Conduct causing no property injury, damage, or financial loss is an infraction; additional state criminal penalties also apply. Collections go to the appropriate trust land fund, with excess damages available to reward county enforcement help.
