Bill Overview

Analyzed Economic Effects

4 provisions identified: 2 benefits, 0 costs, 2 mixed.

Digital asset owners gain sale safeguards

Beginning May 6, 2026, Utah’s regular sale rules require a three-year wait after both custodian receipt and owner notice. The waiting period starts with whichever event happens later. Assets listed on an established exchange cannot sell below the exchange price at the time of sale. Unlisted assets require a commercially reasonable sale method. After a claim is approved, the claimant can request a sale and receive the proceeds after costs.

Digital asset holders must preserve abandoned assets

Beginning May 6, 2026, holders must deliver transferable digital assets in their original form to Utah’s chosen custodian within 30 days after reporting. They must provide proof of delivery on request and submit a reconciliation within 30 days after delivery. Holders without the private key or other transfer authority must report and maintain the assets. They must check at least annually for transfer authority. Once they obtain it, they must deliver the assets at the next reporting cycle.

Utah brings idle digital assets into custody

Beginning May 6, 2026, Utah’s unclaimed-property rules cover qualifying digital assets held, issued, or owed by businesses. These include cryptocurrency, stablecoins, and non-fungible tokens, but exclude securities, game content, gift cards, and loyalty cards. Digital assets are generally presumed abandoned three years after the owner’s last sign of interest. For holders that regularly send physical mail, the deadline is three years after the later of two events: returned first-class mail or the owner’s last sign of interest. These rules let assets enter the state’s recovery process but also subject them to state custody.

Utah can order early digital asset sales

Beginning May 6, 2026, Utah can order a reported digital asset sold when custody is impossible or costs exceed its value. The holder must use a commercially reasonable method, obtain at least the current market price, and deliver proceeds after costs. Utah can also order a sale before the asset’s report is due. A holder that reasonably believes it cannot sell must promptly explain why in writing, and Utah must direct another way to handle it. These powers provide a way to handle assets the state cannot keep, but can turn owners’ assets into cash.
