Utah asserts authority over federal lands

Beginning May 6, 2026, Utah agencies must identify federally controlled lands where the state claims governing authority. Agencies must presume federal ownership does not include governing authority unless the federal government shows specific constitutional authority or authority Utah granted. The law states Utah has not granted that authority over these lands. Utah's Public Lands Policy Coordinating Office must promote state interests when planning for federal lands and resources. These include zoning, resource income, forest and watershed health, wildlife, local school and public safety revenue, and certain public-land roads. This planning duty covers contiguous areas of at least 250,000 acres under common ownership, lease, or unified management.

Utah maps large lands and forest risks

Beginning May 6, 2026, Utah's Public Lands Policy Coordinating Office must identify and digitally map qualifying lands before January 1, 2028. These are contiguous areas of at least 250,000 acres under common ownership, lease, or unified management. Maps must show public access, landscape public nuisance areas, priority mineral lands, and high value mineral areas. By October 1 each year, the office must report map updates and recommended high value mineral zones to the Federalism Commission and the Natural Resources, Agriculture, and Environment Interim Committee. The Division of Forestry, Fire, and State Lands may identify nuisance areas on qualifying lands containing forests with at least 50% tree canopy cover. It may consider vegetation density, forest health, pests, fire fuel, forest and range type, slope, watershed water supply, climate, weather, and other relevant factors.
