Stronger enforcement of student privacy protections
Beginning July 1, 2026, anyone can report suspected student-data violations to Utah’s state education board privacy team. The team must review each report and start an audit or investigation when it is credible, relevant, and detailed enough. Education entities and government agencies contracting for them must notify contractors within 30 days after discovering illegal data use. The notice must explain the violation and termination duty. No sooner than 30 days after notice, the contract must end unless the contractor fixes the violation as far as practical, to the entity’s satisfaction, and establishes steps to prevent recurrence. Contractors cannot charge termination fees, seek damages, or claim other financial liability for this termination.
Student data returned when contracts end
Beginning July 1, 2026, contractors must return or delete personally identifiable student data when an education contract ends without renewal. This covers all such data under the education entity’s control and no longer requires a request from that entity. A contractor can keep the data if the student’s parent gives written consent.
Tighter limits on student data use
Beginning July 1, 2026, contractors cannot use personal identity traits defined by state law to match students with nonprofit colleges or scholarship providers. Matching still requires written permission: a parent gives it through the school or local education agency for a minor. Adult students give their own written permission. The law also removes express permission to use student data to answer a student’s request for information or feedback. That removed permission covered responses not motivated by another party’s payment or something else given in return.
