Bill Overview

Analyzed Economic Effects

10 provisions identified: 5 benefits, 2 costs, 3 mixed.

Taxpayers can combine clean energy credits

Beginning May 6, 2026, eligible taxpayers, estates, and trusts can use two listed credits in the same tax year. They can claim or carry forward the credit under Section 59-10-1106 alongside the credit under Section 59-10-1029. The energy system must be completed and placed in service before January 1, 2028. The remaining eligibility requirements for the clean energy credit still apply.

License exemptions for property owners and workers

Beginning May 6, 2026, property-management license exemptions cover owners and lessors doing covered tasks for property they own or lease. Immediate family members can perform covered tasks for property owned by the owner. Rental-agency regional managers and corporate officials qualify only when they do not perform the covered property-management acts. Workers who exclusively perform maintenance and repairs, or bookkeeping and accounting, also qualify.

Smaller communities can become Utah towns

Beginning May 6, 2026, communities with 75 to 99 people can seek incorporation as Utah towns. Having fewer than 100 residents no longer bars them by itself. They must still meet the remaining town incorporation requirements. This change does not itself set household taxes or benefits.

Utah expands interstate water agreement coordination

Beginning May 6, 2026, Utah's water resources board gains broader authority to cooperate with the state water agent. The law removes the Columbia Interstate Compact exception from that authority for interstate compact negotiations and administration. The Bear River Compact exception remains. The change creates no direct household payment or benefit.

Utah removes one aggravated escape offense

Beginning May 6, 2026, Utah repeals the aggravated escape offense in Section 76-8-309.3. The repeal removes that specific criminal-law provision. The supplied provision does not describe replacement offenses, penalties, or changes to other criminal laws.

Aggravated escape triggers DNA collection rules

Beginning May 6, 2026, DNA collection and analysis rules include aggravated escape under Section 76-8-309.1. Collection applies to people meeting the law's covered conviction, booking, or juvenile adjudication criteria. Covered minors must have been at least 14 when the offense occurred. They must also meet the applicable juvenile adjudication and custody requirements.

Utah repeals two tax credit provisions

Beginning May 6, 2026, Utah repeals the tax credit provisions in Sections 79-6-503 and 79-6-504. This removes those statutory credits and their qualification and application rules. The supplied provisions do not identify credit amounts, eligible taxpayers, or affected tax years beyond the effective date.

Local tax deadlines and owner notices change

Beginning May 6, 2026, municipalities must adopt budgets before June 30, and towns must set property tax levies before June 22. Both deadlines become September 1 when a property tax rate increase is proposed under Utah's truth-in-taxation rules. Towns need State Tax Commission approval for a later levy date. The prior-year revenue calculation excludes minimum basic rate revenue instead of combined basic rate revenue. Beginning July 1, 2026, owners' annual valuation and tax change notices also show the minimum basic rate instead.

Energy zones use pre-designation property values

Beginning May 6, 2026, designated electrical energy development zones use a specific starting value for property tax calculations. The base is the assessment roll value last equalized before the zone was designated. This does not set a tax rate or state how an owner's tax bill changes.

Mining property follows utility assessment rules

Beginning May 6, 2026, state tax officials and county auditors use public utility assessment rules for mining property. The framework covers mines, mining claims, related statements and returns, and assessment equalization. The law does not specify a new tax rate or resulting tax amount.
