Beginning May 6, 2026, Utah's Division of Child and Family Services must check for an existing therapist when children enter custody and help preserve that care. Steps can include contacting the therapist, helping with Medicaid enrollment, or arranging care through a contract. Contracted therapists must join Medicaid or agree to join, and payment cannot exceed the Medicaid rate. When children leave custody, the division must help continue care, including sharing therapist contact details with parents or guardians with the therapist's consent. It must coordinate with the health department when the child, parent, or guardian qualifies for Medicaid, and with local mental health authorities when appropriate. These duties exclude residential treatment, day treatment, partial hospitalization, and other higher-level facilities with integrated mental health care; the division must adopt rules to carry them out.
Beginning May 6, 2026, Utah insurers covering mental health care must offer an agreement to continue covered care with a child's former custody therapist, even outside the plan's network. The child must request it before receiving services and within 90 days after leaving custody, with proof of prior treatment and the departure date. The therapist must agree, follow network provider terms, and receive in-network payment; families pay the usual in-network copays, deductibles, and coinsurance. The agreement must state how long care lasts and which services it covers; it does not add coverage for services the plan excludes. This option excludes custody-period care through residential treatment, day treatment, partial hospitalization, or other higher-level facility programs.
