Covered mental health care beyond networks

Beginning January 1, 2027, Utah insurers must help members get covered mental health and substance use care outside their network when timely in-network care is unavailable. The limit is 15 days after first seeking care, or 24 hours for urgent, emergency, or crisis care. Insurers must arrange a single-case agreement with an out-of-network mental health provider, including for covered telehealth care. You pay only the in-network copay, coinsurance, and deductible; the provider cannot bill you for any extra amount. The insurer and provider negotiate payment, and services must be covered by your plan and within the provider’s scope of practice. Experimental care is excluded unless the insurer covers experimental physical-health treatments consistent with federal mental health parity law. Agreements must specify their length and scope and apply the plan’s network-provider contract terms. Insurers must document payments and provide those records to insurance regulators on request.

Clearer provider lists and billing relief

Beginning January 1, 2027, Utah insurers must publish a provider directory for each health plan and update it at least every 60 days. Directories must be searchable, downloadable, and linked clearly from the insurer’s homepage, without requiring an account or policy number. Members can request printed copies with contact information and notices about how current the information is. Listings must show provider contacts, addresses, specialties, new-patient availability, telehealth options, and hospital, facility, and pharmacy information. They must also explain referral and approval requirements, how networks are built or ranked, and how to report errors. Insurers must investigate reported errors and verify or correct electronic listings within 20 business days; providers must answer verification requests within 15 business days. Providers must have an electronic way to update their information. Insurers must audit directories annually, covering the two most-used mental health specialties and four most-used physical health specialties, or a reasonable mental health sample. They must keep audit records and provide accuracy information when the commissioner requests it, no more than annually. Repeated provider failures to answer verification requests require insurer and commissioner letters, with insurer copies sent to licensing regulators. If you reasonably rely on a wrong listing and the commissioner finds the insurer knew or should have known it was wrong, the commissioner may order coverage of covered care and repayment of amounts above in-network costs. If the provider supplied wrong information or failed to update it, the commissioner may instead require payment to that provider at the in-network rate.
