The law covers qualifying large data centers that begin operating on or after July 1, 2026. These centers withdraw at least 75 acre-feet yearly and meet the law’s facility, building-size, infrastructure, ownership, and land requirements. Before approving their land-use applications, local authorities must notify both state water divisions and the relevant water provider by mail or email. Operators must give the area’s water provider written notice 90 to 360 days before construction begins. They must also report location, estimated yearly withdrawals, discharge treatment and temperature, and water reuse or replacement plans to the Division of Water Rights.
The state must notify data center operators when required preconstruction or annual reports are missing or incomplete. Operators who still fail to file complete reports face fines of up to $100 per day. Each day may count as a separate violation. The state engineer can enforce these reporting duties and act against unlicensed well drilling, unlawful water use, dam-safety violations, and specified reporting or water-distribution violations. Enforcement does not cover direct rain capture that follows local laws, avoids existing water rights, and holds stormwater for absorption or release without beneficial use. Initial orders describe violations and potential penalties; they are exempt from the state Administrative Procedures Act. Enforcement rules must provide a hearing right and timely final orders after nonresponse or correction; outside parties cannot intervene. Final orders receive a fresh court review in Salt Lake County or the county of violation, with petitions due within 20 days. The engineer can seek court enforcement, and winning parties may recover court costs and reasonable attorney fees.
Beginning July 1, 2026, qualifying new data centers must file yearly reports after operations begin. Reports are due July 1 for the previous calendar year and cover actual withdrawals, water-saving efforts, applicable pollution protections, and rule-required information. This reporting requirement does not apply when the state engineer requires water-data reports under another law by rule. By September 1, the Division of Water Rights must publish each reported center’s water withdrawals for the previous year. Specified information stays protected when operators meet state records-law requirements; additional rule-required information is protected only when the rule allows it. The division must publish protected data in anonymous county totals and provide it to affected cities and counties. It must also share nonproprietary report information with the Division of Water Quality and the relevant water provider.
