Utah limits local rules for online marketplaces

Beginning May 6, 2026, Utah cities and counties generally cannot regulate how online marketplaces operate. They cannot demand users’ personal data without an administrative subpoena or court order, subject to the exceptions below. Personal data means information linked or reasonably linked to an identifiable person. Covered marketplaces are paid digital services that advertise goods or services in Utah and help people transact, exchange offers, or connect. Payment need not be a transaction fee. Local governments can still regulate transaction participants and adopt or enforce short-term rental ordinances allowed under Utah law. They can also request voluntary cooperation, enforce Utah criminal law, and bring civil lawsuits to protect their intellectual property.
