Beginning May 6, 2026, Utah private probation providers must screen defendants' risks and needs. If the screening identifies a needed assessment, treatment, or service, the provider must list every available human services program offering it. The defendant can choose which listed program to use.
Beginning May 6, 2026, Utah limits combining private probation with other paid services for the same defendant. Private probation providers cannot also provide services for which a human services program pays them. Separately, human services programs cannot combine probation with other paid services unless no other program offers those services within 50 miles of the defendant's home. That exception also requires the defendant's written informed consent. Separate consent paragraphs must explain the added services, withdrawing consent, complaint procedures, and possible conflicts of interest. Complaint instructions must explain how to contact and file with the state's licensing investigation office. The related service contract must list the fees charged to the defendant. Utah must revoke a private probation provider's license for violating the ban on services paid for by a human services program.
