Employers can recover survivor health costs

Beginning May 6, 2026, Utah creates the Local Public Safety and Firefighter Surviving Spouse Trust Fund. Its board can repay employers for eligible health premiums or health savings account contributions for surviving spouses and dependent children. These costs must follow a line-of-duty death and have been paid from May 1, 2024, through May 6, 2025. Reimbursements go to employers, not directly to families. The fund receives program fees, any legislative funding, donations, grants, other revenue, and interest; this law provides no new funding. After actual department administrative costs, revenue and interest must lower employer fees under the survivor coverage program. The board can also use the fund for reasonable department and board administrative costs. The department must track receipts and spending or hire an outside administrator to do so. Deposits cannot be taken back, assets are reserved for the program, and creditors of employers or the board cannot seize them.
