Transfer-fee protections without required county screening

Beginning May 6, 2026, a transfer-fee notice that substantially meets filing requirements is valid unless it is a wrongful lien. It is wrongful if, when recorded, foreclosure of a higher-priority mortgage or trust deed had made the fee unenforceable. A missing required earlier notice or a recorded document ending the fee also makes the notice wrongful. County recorders do not have to screen these notices for wrongful liens under the specified notice rules. A court's wrongful-lien finding invalidates the notice, even if the recorder accepted it.

Reinvestment fees skip recurring notice filings

Beginning May 6, 2026, reinvestment fee covenants are exempt from the private transfer-fee notice filing rules, including three-year renewals. This removes filing duties for parties handling these fees and the required notice updates for affected property owners. Reinvestment fees remain subject to their own separate rules.
