Bill Overview

Analyzed Economic Effects

3 provisions identified: 2 benefits, 0 costs, 1 mixed.

Home cooks’ sales become tax exempt

Beginning July 1, 2026, sales of food, food ingredients, or prepared food by home cooks are exempt from Utah sales and use tax. The exemption removes that tax from covered sales.

Homemade food producers can use representatives

Beginning May 6, 2026, producers covered by Utah’s homemade-food law can name representatives to handle their products. Representatives can distribute, sell, deliver, hold, store, or offer the food for sale. Sales must go directly to an informed final customer at a direct-to-sale location. Producers keep ownership unless they agree with the representative to share or transfer it.

Homemade food markets drop warning signs

Beginning May 6, 2026, direct-to-sale farmers markets selling homemade food no longer need signs saying products are uninspected. These markets generally remain limited to products not certified, licensed, regulated, or inspected by state or local authorities. That limit does not apply to markets made up only of minor producers or minor-operated businesses. When associated with another farmers market, the direct-to-sale area must remain separate, with signs or markings identifying both areas.
