More patients can seek experimental treatments

Beginning May 6, 2026, Utah expands which patients can seek experimental drugs or devices through its right-to-try law. A doctor licensed under Utah’s medical or osteopathic practice laws must diagnose a terminal or eligible illness. An eligible illness must pose a substantial risk that is severely disabling or life-threatening. Conventional treatments must have been explored, with no satisfactory option or option comparable to the experimental treatment. Terminal illness includes a condition that inevitably leads to death and poses greater risk than the experimental treatment. It also includes cancer as determined by a board-certified cancer doctor. Terminal patients must have exhausted conventional treatments and have no satisfactory or comparable option. Covered dosage forms include tablets, capsules, concentrated oils, liquid formulations, skin preparations, and preparations taken under the tongue. Liquid formulations replace the narrower reference to liquid suspensions. Eligibility does not guarantee that a manufacturer provides treatment.

Tighter rules for experimental treatment access

Beginning May 6, 2026, qualifying experimental drugs and devices must meet federal definitions and have completed FDA Phase 1 testing. Drugs must meet Part 312 rules, and devices must meet Part 812 rules. For an eligible illness, devices must remain under investigation, and drugs must remain in a Part 312 clinical investigation. Manufacturers providing these products to Utah patients must report to the Health and Human Services Interim Committee before the following November 1. Reports must list the number of patients treated for eligible illnesses, each illness treated, and adverse outcomes likely caused by treatment. Manufacturers also include any other information they consider relevant. Reporting is not required when the patient participated in an FDA-regulated investigation under Part 312 or Part 812.
