Borrowers get debt balance rules in court

Beginning May 6, 2026, Utah law sets balance rules when creditors make closed-end consumer debt due early and obtain judgments. The creditor must calculate the balance as if the borrower paid in full on the judgment date. Any legally allowed offset is subtracted from the balance. The judgment still earns interest at the rate agreed to for the debt.

Borrowers generally cannot recover prepaid charges

Beginning May 6, 2026, Utah borrowers generally cannot recover prepaid finance charges when paying closed-end consumer debt early. These are loans with a set repayment schedule, rather than revolving credit. A refund is allowed only if the borrower and creditor expressly agree to it. The law uses the federal Regulation Z definition of prepaid finance charges. These charges do not count as prepayment penalties.
