Utah doubles investor protection fund cap

Beginning May 6, 2026, Utah raises its securities education and enforcement fund's year-end balance cap from $500,000 to $1 million. The Division of Securities must transfer any year-end balance above $1 million to the state's General Fund. The fund receives civil penalties and administrative fines under state securities law, and keeps the interest it earns. It also receives fines the division collects after July 1, 1989, through voluntary settlements or administrative orders. Money can support investment education for Utah residents, training for securities registrants and licensees, investigations, lawsuits, and securities fraud reporting awards. Spending requires approval from the securities director, the commission, and the Department of Commerce's executive director. The law provides no new appropriation and does not directly change household taxes or benefits.
